The following terms and conditions apply between Massage Bavaria First Class (hereinafter “MBFC“) and the customer (hereinafter referred to as “Customer“) for all services offered. The subject of the general terms and conditions is the commercial exercise of mobile wellness massages.
I. General
MBFC is a service company in the field of mobile wellness massages in Munich / Bavaria. The treatments are carried out in the hotel, in the office (on the massage chair) or privately at the customer. MBFC stands for wellbeing, health, physical and mental relaxation; this in the sense of wellness.
Wellness massages are used for rest and relaxation. They are not medical treatments. The applications offered by MBFC are for wellbeing. There is no diagnosis and no promises of healing are given. The wellness massages offered by MBFC are only suitable for healthy people and are only carried out on them. The cost of MBFC treatments will not be reimbursed by health insurances or insurance companies.
II. Disclaimer
If, despite expert use, any damage to property or personal injury to the customer occurs, MBFC, the business owner, the MBFC self-employed masseur, is exempted from all liability.
Before becoming a self-employd masseur to MBFC, all masseurs are fully audited for education, expertise and work experience. All masseurs at MBFC are self-employed and self-employed for MBFC. MBFC is not liable for the masseurs or any damage caused by them. Furthermore, MBFC disclaims any liability for damage to the patient resulting from failure to comply with the terms and conditions or by the patient’s misconduct or negligence.
MBFC, the business owner, the masseur is exempt from all liability for any occurring consequential damages that are due to the fact that the customer conceals reasons of exclusion, or reasons for exclusion are not known to the customer and for the masseur are not recognizable.
This disclaimer also applies to the booking of massages during pregnancy, as well as any health restrictions of any kind. By booking an appointment with MBFC you automatically agree with the disclaimer and the terms and conditions.
III. Treatment exclusion
MBFC reserves the right to decline treatment for medical, hygienic or personal reasons.
IV. Dates, cancellation
Booked appointments can be cancelled free of charge up to 24 hours before the start of the massage. This cancellation must be made in the booking confirmation e-mail that the customer received after booking. If the cancellation is made less than 24 hour before beginning of the massage, 50% of the gross massage price will be charged as cancellation fee.
V. Prices, payment
All prices quoted are gross prices (including current statutory value added tax). The drive is included in the price. With the option “on-the-spot payment”, payment must be made on the spot after the treatment. It is also possible to pay by online booking via Paypal or credit card. If the customer needs a receipt or invoice, he will be issued.
Vi. Data protection
The customer agrees to the collection, processing and use of his personal data. Storage is exclusively within the scope of use by MBFC. A disclosure to third parties does not occur. All personal information will be treated confidentially.
VII. Final provisions / Severability clause
Should individual provisions of this contract be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the remainder of the rest remains unaffected. The ineffective or unenforceable provision shall be replaced by an effective and enforceable provision whose effects come closest to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply mutatis mutandis in the event that the contract proves to be incomplete. Place of performance and jurisdiction is the headquarters of MBFC, Munich. German law applies.
